1. About these terms

These terms govern your use of the FertilityNXT website. Use of the FertilityNXT platform itself is governed by the master services agreement, order form and data processing agreement signed between FertilityNXT and the customer clinic. Where those documents conflict with this page, they take precedence for the platform.

2. Website use

You may use this website for lawful purposes connected with evaluating, purchasing or supporting our services. You may not attempt to gain unauthorised access to any part of it, interfere with its operation, scrape it at a scale that degrades service for others, or use it to transmit unlawful or harmful material.

3. Not medical advice

Content on this website describes clinical software. It is not medical advice, and nothing here should be used to diagnose, treat or make a clinical decision about any individual. FertilityNXT is a clinical workflow and decision-support system operated by qualified clinical staff who remain fully responsible for every clinical decision made using it.

4. Intellectual property

All content on this website, and the FertilityNXT software, design, documentation and trade marks, are owned by FertilityNXT or its licensors. You may not copy, modify, distribute or create derivative works without our written permission, except as expressly permitted by a signed agreement.

5. Customer data

Customers retain full ownership of all data they enter into the platform. We claim no ownership of clinical records, and we do not use customer clinical data to train models for other customers without an explicit written agreement. Customers may export their data in a structured format at any time, including on termination.

6. Availability

We aim to keep this website and the platform available at all times but do not warrant uninterrupted access to the website. Any contractual availability commitments for the platform are set out in the agreement signed with the customer.

This website may link to third-party sites. We do not control them and are not responsible for their content, practices or availability.

8. Limitation of liability

To the fullest extent permitted by law, FertilityNXT is not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill, arising from use of this website. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited. Liability arising under a platform agreement is governed by that agreement.

9. Changes

We may revise these terms from time to time. The version published here at the time you use the site is the version that applies.

10. Governing law

These terms are governed by the laws of India, and the courts of Bengaluru have exclusive jurisdiction, except where mandatory local law grants you rights in another jurisdiction.
